1. About these terms
These Terms & Conditions govern the relationship between you and Merry Morocco (“we”, “us”, “our”) when you book or use our tours, day trips and travel services. By making a booking you accept these terms on behalf of yourself and everyone in your party. Please read them alongside our Booking & Cancellation Policy and Privacy Policy.
2. Definitions
- “Tour” / “services” — any trip, excursion, transfer, accommodation or activity booked through us.
- “Lead traveller” — the person who makes the booking and is responsible for the party.
- “Supplier” — a third party (hotel, riad, transport, guide, activity provider) delivering part of your tour.
3. Booking & contract
A contract is formed when we confirm your booking in writing and you have paid the required deposit. The lead traveller must be 18 or over and warrants that all information provided is accurate. Please check your confirmation carefully and tell us immediately of any errors.
4. Prices & payment
Prices are confirmed at the time of booking. Deposits, balance due dates, accepted payment methods and currency are set out in our Booking & Cancellation Policy. We reserve the right to correct genuine errors in advertised prices before your booking is confirmed.
5. Your responsibilities
You are responsible for arriving at the agreed times and locations, following the reasonable instructions of guides and drivers, and behaving in a way that does not endanger or disrupt other travellers. You must disclose any medical condition, disability or dietary requirement that may affect your participation so we can advise on suitability.
6. Passports, visas & health
You are responsible for holding a valid passport, any required visas, and appropriate vaccinations or health precautions for travel to and within Morocco. We are not liable for any loss arising from your failure to meet these requirements. Check current entry rules with the relevant authorities before you travel.
7. Our liability
We take reasonable care to provide the services described. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, nor for matters beyond our reasonable control. Where suppliers deliver elements of your tour, their own terms and liability may also apply. Nothing in these terms limits liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded by law.
8. Itinerary changes
Itineraries are planned in good faith but may change due to weather, road or border conditions, safety, supplier availability or other operational reasons. We will aim to provide alternatives of comparable standard. Minor changes do not entitle you to a refund.
9. Cancellation & refunds
Cancellation by you or by us, and the associated charges and refunds, are governed by our Booking & Cancellation Policy, which forms part of these terms.
10. Travel insurance
Comprehensive travel insurance is strongly recommended for every traveller and should cover cancellation, medical care, repatriation and personal belongings for the full duration of your trip.
11. Conduct
We may decline to carry, or remove from a tour, any person whose behaviour is unsafe, unlawful or seriously disruptive, without refund and without liability for resulting costs. Please also respect local customs, sites and the environment throughout your trip.
12. Website & intellectual property
All content on this website (text, images, logos, itineraries and design) is owned by or licensed to Merry Morocco and may not be copied or reused without our written permission.
13. Force majeure
We are not liable for failure to perform our obligations due to events beyond our reasonable control, including war, civil unrest, terrorism, government action, border or road closures, epidemics or pandemics, extreme weather, natural disasters, fire or strikes.
14. Governing law & jurisdiction
These terms are governed by the laws of [the Kingdom of Morocco], and any disputes shall be subject to the exclusive jurisdiction of the courts of [Marrakech, Morocco], unless a different mandatory consumer-protection law applies to you.
